Slip and fall claims refer to injuries that occur when an existing dangerous or hazardous condition results in a person slipping, falling or tripping on another person’s property resulting in an injury. Such personal and accidental injuries are generally included in an area of law referred to as premises liability.

Slip or trip and fall accidents can result in many different kinds of injuries including:

By law, the landowner must act as any reasonable individual would under the same circumstances. A property owner, for example, may not owe a duty of care to a trespasser.

Of course, individuals are responsible for watching where they are going. If an individual is careless in avoiding the condition or not seeing the hazardous condition that caused the injury, then this oblivious behavior will be taken into consideration under the principle of contributory negligence.

When it comes to slip and fall injuries, the victim must be able to prove that he or she was lawfully on the private property, or was on public property at the time the accident transpired. He or she must also establish that the property owner or manager was aware of the hazardous condition but did not correct it.
