Fatal Car Accidents in South Carolina
Fatal accidents in South Carolina are the cause of countless deaths every year. The unfortunate truth is that many of the incidents are preventable. We see innocent people die daily as a result of drivers who are reckless and negligent. Speeding, operating a vehicle while impaired, and distractions are some of the most common factors in many of the collisions across our state.
After enduring the loss of a loved one, families are able to take legal action to hold those responsible to account. It is vital that families are able to prove negligence existed at the time of the accident. This involves proving the following four elements:
- Duty: The defendant owed a legal duty of care to the victim who lost their life in this accident. This means that they had an obligation to act reasonably to prevent harm.
- Breach: The defendant breached the duty of care that was owed to the deceased victim by failing to meet the standard of care expected under the circumstances.
- Causation: The defendant’s breach of duty directly caused the fatal accident to take place, without which the fatal injury would not have occurred.
- Damages: The plaintiff suffered actual damages as a result of the fatal collision, such as physical injuries or financial losses, as a result of the defendant’s breach of duty and causation.
It is imperative to seek guidance from a wrongful death lawyer immediately to demonstrate that these elements existed.
