Fatal Head-On Collisions in South Carolina
Dealing with the sudden and unexpected loss of a loved one due to a fatal collision can be incredibly difficult. Regrettably, every month, more than 100 individuals lose their lives in fatal collisions across our state. The cumulative toll amounts to over 1,700 lives claimed by negligent and reckless drivers who frequently precipitate these accidents. Speeding, distractions, and impairment can yield devastating consequences for drivers on our roadways, often resulting in severe injuries in head-on collisions.
Following the loss of a loved one, families have the option to file a wrongful death claim against the responsible party, seeking compensation for the losses and damages incurred.
In South Carolina, damages awards adhere to the modified comparative negligence doctrine. According to this doctrine, a person can recover compensation for damages arising from a fatal motor vehicle accident as long as the fault of the deceased party does not exceed 50 percent.
If the loved one was more than 50 percent responsible for the accident, the family is barred from seeking compensation. For this reason, having a South Carolina wrongful death lawyer is crucial for guiding your family and advocating for justice. Your attorney will present compelling evidence against the defendant, demanding compensation for loss of companionship, loss of services, funeral costs, and more.
