Fatal Pedestrian Accidents in Georgia
In 2022, nearly 1800 people died as a result of fatal crashes in the state of Georgia. Unfortunately, this number is only set to increase in 2023, as we have already witnessed a significant number of fatalities on our roadways. After experiencing the sudden and unexpected loss of a loved one, families have the ability to file wrongful death claims to recover compensation for some of the damages they face.
While many states cap compensation in civil cases, Georgia offers a crucial exception for wrongful death claims. In a landmark 2010 ruling, the Georgia Supreme Court declared damage caps unconstitutional, paving the way for full financial recovery for victims’ families.
This means no ceiling exists for economic losses, encompassing items like lost income, medical expenses, and funeral costs. Similarly, non-economic losses like grief, loss of companionship, and emotional distress can be compensated without limitation. With that being said, there is a cap on the amount of punitive damages that families can recover.
Given the fact that there are no limitations on the economic and non-economic damages that families endure after experiencing the loss of a loved one, George’s legal system empowers families to recover full and fair compensation for all of the losses and damages they face. If you have lost a loved one due to a fatal collision, it is vital that you seek representation from a wrongful death lawyer right away. Your attorney will be able to get started on building a case for you against the defendant and demanding full and timely compensation for all of the losses and damages you face.
