Fatal Car Accidents in South Carolina
More than 100 people die every month as a result of fatal crashes in South Carolina. These accidents often have a devastating impact on families, who are often left to grieve the overwhelming and unexpected loss of loved ones.
After experiencing the loss of a loved one, families have the opportunity to file a wrongful death claim against the driver who is responsible. In South Carolina, awards for damages are provided based on the modified comparative negligence rules. This rule states that bereaved families are able to recover compensation for all of the damages that were caused by other parties involved in the crash. However, the amount of money recovered will be reduced based on the amount of fault that was shared by their loved one. However, they must be able to demonstrate that their loved one was less than 50 percent at fault for the accident, or they will not be able to recover any compensation.
Seeking legal guidance can make a big difference. Your attorney will be able to meticulously analyze all of the evidence on your behalf and build the strongest case against the defendant. They will negotiate fair compensation to ensure your family has the financial resources needed to move forward during this very difficult time. Waiting can prevent you from maximizing your recovery and may make it more difficult to reach out to witnesses or gather evidence. For this reason, it is crucial to seek guidance from a wrongful death lawyer in Charleston right away.
