Fatal Car Accidents in North Carolina
Hundreds of fatal collisions are reported in North Carolina annually. Dealing with the aftermath of a fatal collision can be incredibly difficult. Unfortunately, we see many families forced to deal with overwhelming emotional and financial consequences. After experiencing the loss of a loved one, your family has the ability to file a wrongful death claim against the responsible party. There are various parties that have the legal right to take action after a fatal collision.
If the wrongful death victim was married at the time of their demise, only the spouse is eligible to initiate a wrongful death lawsuit. In the event that the wrongful death victim was unmarried at the time of death, the right to pursue legal action is vested in the victim’s children. Should the wrongful death victim have neither children nor a spouse, the right to file a wrongful death lawsuit is extended to the victim’s surviving parents.
In cases where the wrongful death victim lacks children, a spouse, or living parents, the authority to take legal action then rests with the administrator of the victim’s estate. It is important to take quick legal action by reaching out to a wrongful death lawyer in North Carolina right away. An attorney will be able to give you the best chance of protecting your rights and getting justice while holding the negligent party accountable.
