Fatal Car Accidents in South Carolina
Fatal accidents take place daily in South Carolina. The unfortunate truth is that we see many innocent people die as a result of accidents that are completely preventable. When drivers do not operate their vehicles in a safe manner, it can have deadly consequences. After losing a loved one in a fatal collision, your family can take legal action against the responsible party.
In South Carolina, the laws of comparative negligence play a crucial role in filing a wrongful death claim following a fatal car crash. The state follows a modified comparative negligence system, where compensation is determined based on each party’s degree of fault. If the deceased individual shares some responsibility for the accident, their family may still pursue a wrongful death claim, but the damages awarded will be reduced proportionately to the percentage of fault they share. However, if the deceased is deemed more than 50% responsible, their family may be barred from recovering any damages.
Seeking help from a wrongful death lawyer can provide you with the support and guidance needed to pursue justice for your loved one’s untimely passing. By filing a wrongful death claim, you may be able to receive compensation for financial losses such as funeral expenses and medical bills, as well as damages for loss of companionship and guidance. It is important to seek legal counsel immediately after the accident to ensure that you have strong evidence against the responsible party. Your attorney will fight on your behalf, giving you the time and space needed to grieve while they work toward obtaining the justice your family deserves.
