Fatal Auto Accidents in South Carolina
Fatal accidents claim numerous lives in South Carolina each year, profoundly affecting surviving families. After experiencing the loss of a loved one, demonstrating negligence becomes imperative. A South Carolina wrongful death attorney must establish that the negligent party’s actions directly caused the decedent’s death.
In a wrongful death lawsuit, it’s crucial to prove the following:
- The individual’s death occurred.
- The death resulted from another individual, entity, or organization’s actions.
- The plaintiffs suffer financial hardships due to the loss.
- A legal representative for the survivors has been appointed in accordance with state laws.
In South Carolina, the statute of limitations for filing a wrongful death claim is three years from the date of the family member’s passing. Given this timeframe, it is essential for the estate’s executor to seek legal representation promptly from an experienced wrongful death attorney to allow sufficient time for building a compelling case. Once negligence is proven, compensation for various damages can be pursued, including:
- End-of-life, medical, and funeral expenses.
- Lost financial support.
- Loss of services and assistance.
- Unattainable potential inheritance.
- Absence of companionship and emotional support.
- Emotional and physical distress experienced by survivors.
- Void left by the absence of guidance and guardianship.
