Fatal Motor Vehicle Accidents in Georgia
The sudden loss of a family member can present significant challenges. Tragically, over 100 individuals lose their lives in fatal collisions in our state every month. These accidents contribute to more than 1500 people losing their lives due to the actions of negligent and reckless. Speeding, distractions, and impairment can all lead to severe consequences for drivers on our roads.
After experiencing the loss of a loved one, families have the option to pursue a wrongful death claim against the accountable party. This legal recourse enables families to seek compensation for the losses and damages they have endured.
In our state, awards for damages are governed by the modified comparative negligence doctrine. According to this principle, an individual can seek compensation for damages resulting from a fatal motor vehicle accident as long as the deceased party’s fault does not exceed 50 percent.
If the loved one bears more than half of the responsibility for the accident, the family is ineligible to pursue compensation. Thus, it is imperative to enlist the support of a proficient Georgia wrongful death lawyer to advocate for your family and pursue justice on your behalf. Your attorney will skillfully present compelling evidence against the defendant, seeking compensation for expenses like funeral costs, loss of services, loss of companionship, and other pertinent damages.
