Fatal Auto Accidents in South Carolina
Experiencing the loss of a loved one as a result of a fatal collision can be challenging to deal with. Unfortunately, countless lives are lost as a result of collisions in South Carolina every year.
Far too often, these crashes are a result of negligent motorists. When drivers do not operate their vehicles carefully, it can have deadly consequences. Unfortunately, fatal collisions often have an overwhelming impact on surviving family members.
Families often face overwhelming financial burdens related to medical costs, funeral arrangements, and more. To help alleviate some of the stress that families face, it is crucial that they seek guidance right away from a dedicated wrongful death lawyer. After the loss of a loved one, families have the opportunity to file a wrongful death claim against the person responsible.
In South Carolina, damages for losses are paid based on the modified comparative negligence rule. This means that as long as your loved one is less than 51 percent responsible for the accident, they have the opportunity to request compensation for any losses and damages caused by the negligence of another person. It is important to remember that if your loved one contributed to the accident in any way, the amount of compensation your family is able to receive will be reduced to reflect their share of fault. This makes it vital to seek legal representation early on to ensure you have the best chance of getting justice.
