Charlotte, NC – Two Killed in Fatal Crash on Old Concord Rd at Oar RdAnnually, the United States reports over 40,000 deaths due to motor vehicle incidents. Unfortunately, our state also experiences its share of tragic losses, with many individuals losing their lives in accidents that could have been avoided.

When a person’s death is caused by another individual’s negligent or wrongful actions on the road, the deceased’s surviving relatives may have the right to seek monetary compensation for their suffering by initiating legal action against the party at fault. This financial compensation is intended to cover various expenses such as funeral costs, medical bills, and lost wages, offering some level of financial relief during a particularly challenging period.

It’s important to be aware that the rules surrounding claims for wrongful death vary from one state to another, including the types of damages that can be claimed. Although no amount of money can replace the presence of a loved one or fully remove the pain of loss, receiving compensation can reduce some of the economic strain brought about by their sudden departure.

To advance a claim for wrongful death successfully, it is necessary to prove four essential elements: the existence of a duty of care (the defendant had a responsibility toward the deceased), breach of this duty (they failed in their responsibilities), causation (their failure directly led to the loss of life), and damages (specific financial losses incurred as a result).
