Fatal Car Accidents in Georgia

Woodstock, GA – One Teen Killed in Crash on Towne Lake PwkyFatal automobile accidents take place every day in Georgia. Unfortunately, these accidents have overwhelming consequences for families. After losing a loved one, many families struggle mentally and emotionally. To make matters even worse, they often face significant financial burdens. When victims lose their lives due to negligence, families may be able to pursue legal action for compensation.

Georgia follows a Modified Comparative Fault system, which is crucial in determining liability and damages in personal injury cases. Under this legal framework, an injured party can seek compensation as long as their own fault does not exceed 50%. In other words, if an individual is found to be 49% or less responsible for an accident, they can still recover damages proportionate to the other party’s degree of fault. However, if the injured party’s fault is deemed to be 50% or more, they are not able to recover any compensation for the resulting damages. It’s important to note that even when eligible for compensation, the damages awarded are reduced by the injured party’s percentage of fault.
