Fatal Auto Accidents in Georgia

Chatham Co., GA – Chatham Parkway Crash Takes One LifeFatal accidents occur far too often in Georgia. In fact, automobile collisions claimed the lives of hundreds of people every year. In many cases, these accidents are preventable. However, negligence continues to contribute to many of them. In Georgia, beery families have the ability to file wrongful death claims against responsible drivers. It is important to know that comparative negligence laws can impact the amount of compensation your family is able to recover by filing a wrongful death claim.

Under comparative negligence laws, each party’s level of fault is assessed and assigned a percentage value. This percentage represents how much each party contributed to the accident. For example, if one driver was speeding but the other ran a red light, they may be found 75 percent at fault and 25 percent at fault.

In Georgia, our state follows the modified comparative negligence rules. Under this system, an injured party can only recover damages if their percentage of fault falls below 51 percent. If their contribution exceeds this threshold, they are barred from recovering any compensation.
