Fatal Auto Accidents in South Carolina

Greenville, SC – Woman Killed in Hwy 14 Crash ID’d by PoliceFacing the sudden and unexpected loss of a loved one due to a fatal collision is a profoundly challenging experience. Every month, our state mourns the loss of more than 100 individuals who fall victim to fatal accidents on the road. Annually, this number rises to over 1,700 lives lost, often due to the negligent or reckless actions of drivers. Issues such as speeding, distractions, and driving under the influence are common causes that lead to tragic outcomes, including severe injuries from head-on collisions.

In the wake of such a tragedy, families are left with the option to pursue a wrongful death claim against those deemed responsible, aiming to secure compensation for the various losses and damages suffered.

South Carolina observes the modified comparative negligence rule in determining compensation for wrongful death cases. This rule allows for recovery as long as the deceased did not hold more than 50 percent of the blame for the accident. If it is determined that they were more than 50 percent responsible, the possibility of obtaining compensation is unfortunately foreclosed. This highlights the importance of having a knowledgeable South Carolina wrongful death attorney by your side to assist in navigating these legal waters and striving for justice. An attorney will focus on presenting strong evidence to support your case, aiming to secure compensation for emotional and financial losses such as loss of companionship, loss of services, and funeral expenses.
