Fatal Car Accidents in South Carolina

Pickens Co., SC – Randall Davenport ID’d as Childress Rd Crash VictimDealing with the sudden loss of a loved one can be immensely challenging. Sadly, each month sees over 100 individuals lose their lives in fatal collisions throughout our state. These incidents result in over 1700 lives lost due to the negligence and recklessness of drivers who often cause these accidents through speeding, distractions, or impairment.

Following the loss of a loved one due to an unexpected collision, families have the option to file a wrongful death claim against the accountable party. This legal action seeks to obtain compensation for the losses and damages incurred.

In South Carolina, awards for damages adhere to the modified comparative negligence doctrine. This principle dictates that individuals can seek compensation for damages resulting from a fatal motor vehicle accident as long as the fault of the deceased party does not exceed 50 percent.

Should the loved one bear more than half the responsibility for the accident, the family is barred from seeking compensation. For this reason, it is crucial to have a dedicated South Carolina wrongful death lawyer to provide guidance and fight for justice on your behalf. Your attorney will marshal compelling evidence against the defendant and pursue compensation for funeral expenses, loss of services, companionship, and more.
